It can happen anytime. But for the most part, if your military rating is below 100, you will have to pay some tribute or they will be breaking out very soon.

Also, if your relations are at Hostile, they will declare war, but only if they're stronger than you. They'll leave you alone and start sucking up to you if you are strong enough to crush them beneath your heel.

my military rating seems to be very erratic- one turn its 87 and then another turn its 137. whats up with that?

Well, if any ships have been completed that turn or if you've put ships in orbit of planets, that would cause such an increase. Or even more likely, some of your opponents fleet got wiped out causing your fleet to be the stronger one, hence the higher rating.
