Activision Retaliates Against Spark

Activision has counter-sued Call of Duty: Finest Hour developer Spark Unlimited, adding a few more accusations to the mix. Spark started the battle at the end of August when they charged Activision with fraud and breach of contract after the two companies couldn't come to an agreement on a sequel. According to Gamespot, Activision has now charged Spark with those same allegations adding trade secret misappropriation, trademark infringement, false designation of origin, and false advertising.
Gamespot obtained a copy of the countersuit, which turns out to be vastly different than Spark's initial claim - stating that Spark had approached Activision in the first place, pitching a new idea, and a new firm for Activision to team with as they struggled to break into the World War II FPS market. Craig Allen, CEO of Spark Unlimited, also claimed that the founding members of Spark were "the creators of the Medal of Honor franchise and those primarily responsible for Medal of Honor Frontline for the PlayStation 2."
Activision states simply that "Allen knowingly made these representations to Activision to convey the false impression that Spark would be comprised of the group that could take credit for creating, developing, and producing Medal of Honor from beginning to end and which was responsible for its success."
