The Entertainment Software Association and Video Software Dealers Association have joined forces by filing a lawsuit protesting California's AB1179 bill that Governor Schwarzenegger signed ten days ago. The new law will go into effect this January and will hold retailers liable for $1,000 fine if they sell 'M' rated games to minors.
The suit claims that the bill violates First Amendment rights by restricting access to games "based solely on their expressive content." This is one of many bills that the ESA and VSDA have stood up against, and they have currently won all their battles. ESA president Doug Lowenstein laminated that fact when he said "We believe this bill will meet the same fate as virtually identical statutes that federal courts have routinely struck down in recent years."
