Friday saw another video game bill created after Grand Theft Auto's infamous 'Hot Coffee' scandal get shot-down in court. The Illinois law, which reads like the California law approved by Gov. Schwarzenegger last October, was to go in effect on January 1st and would fine retailers $1,000 if they were found selling Mature games to minors.
As has been in the case in various bills like this one, it was taken to court for breaching the First Amendment by the local Retail Association. "It's unfortunate that the state of Illinois spent taxpayer money defending this statute. This is precisely what we told them would happen," said David Vite, president of the Illinois Retail Merchants Association, one of the groups that sued over the law.
"In this country, the state lacks the authority to ban protected speech on the ground that it affects the listener's or observer's thoughts and attitudes," said U.S. District Court Judge Matthew Kennelly.
