Yes, the script clearly states that the death star is starting to be built. Darth Vader and one of the higher ups in the Empire are in the final scene, watching the construction start. Exactly. But, you see, a lot of products are sold in stroes because of volume sales up front. Regardless that the profit is not much compared to the " Wholesale" price, they are still selling a bunch of games and reaping first release benifits.
