**UPDATE** 2 days ago my son tried one last time with safari ( I gave him the Ipod 1st gen after getting a new 3G) and it is working... I'm not sure why or how but all of a sudden it just started being seen by the router and is accesing wifi again. Almost as if the wifi was reenabled on it.

It all boils down to this, you bought a point release. You got what you paid for. If you dont think OD is worth the wait, feel free to move on.
