Go back and reread, please. The "this damage is not speculative" line appears in the paragraph addressing customer discontent and reputational losses, not the financial losses. From filing 39 :
I don't need to reread anything, you either aren't listening or only hear what you want. I have been saying not that Blizzard doesn't have a formula or didn't come up with it through averages. What I am saying is I find their assumption that every player would have pla
No, it's Blizzard suing the guy selling tool kits to beat all the anti-theft devices.
I see so your analogies are the only ones that count?
I am sure some would not. I am also sure some would have continued playing well past the 8 months. That's why it's called an average.
No Blizzard specifically states that the damages are not speculatively, they say nothing of an average they are saying they want 8 months of fees for every player banned.&
Figure that for every customer that complains, approximately ten do not. 465,000 complaints means 4,650,000 people aren't complaining, but are unhappy. I think the total number of players in the US and EU comes to approximately 5-6 million, so odds are good that the majority is unhappy with this. Also, the average WoW player subscribes for 7 months. A lot of players who would play normally otherwise give glider a try and get banned.
Sorry I am not going to figure anythin
You bet your ass they would have! Do YOU have a WoW account? If so, you would understand.
Are you seriously listening to yourself? You honestly believe that every single user that got banned would have signed up again and started playing again? Thats a stretch and even if only one didn't that proves my point. Second if that was such an issue why isn't Blizzard sueing every user they have banned to get their 8 months of subscription fees? I'll tell
First, not all data is being released to the public. Second, the expert was commenting on USABLE bots - ones that are nearly undetectable. Third, MDY agrees that Glider is responsible for most of Blizzard's bot-related expenses. When even the offender admits they're causing the problem, the facts aren't really in dispute.
First that means you are assuming just like me! ;) Second I thought all bots were harmful sounds like they are using this one to gain back for
Again, the precise figures and methodologies for obtaining them do not seem to be available to the general public. It's very well possible they have all of the proof they need. You are only assuming they don't.
Sorry but without the same documentation you are saying I am missing you are only assuming also. Which is what this whole thread is about! :)
Several hundred thousand. You're off by a rather large factor. That's about 5% of their entire consume
Blizzard claims $10.5 million losses from accounts banned due to glider use - accounting method assumes each banned account would have continued subscribing an average of seven months had it not been banned.
This has to be the worst of all, total speculation how someone can claim this is beyond me. So they are assuming that all these subscribers that were to damn lazy to play the game and cheated would have played it for seven more months with out Glider? I s
um ?? I never said they werent multiplayer ,just that you didnt have to pay a monthly subscription to play once you bought it .. Go buy one and test it out..no pay to play
What are you talking about? I play multiplayer games all the time without paying a monthly fee! In fact I play MMOs alot without a monthly fee (won't play one with a fee) such as Guild Wars, Archlord, Runescape, Fury, 9 Dragons and those are the ones I have played there is a long list of other fr
It is my belief Hackers and cheats killed off the simple buy and play games, how? As stated above, once the games were sold the companies had to keep throwing money at them to keep the game play fair for all, deducting from the bottom line. So a new game style was born "pay to play", the monthly subscriptions are used to keep development going and fight off cheats/hackers.
Uhm what the heck are you talking about? Just about every game released has a multiplayer op
I don't see it either...but then there's a valid reason for that...I am not privy to Blizzard's bank accounts. Blizzard doesn't need to convince me...or you that they are suffering 'loss'....only the Judge hearing the case.
I wasn't stating that they had to show me, I was simply stating that should be a criteria for a case to go to court. Just like this case should. I never said that they had to convince me, but that doesn't mean I can't disagree with it now
I'm sorry, I did not say he was potentially destroying Blizzard's business. I asked you if you believed that Blizzard could only act to defend itself when someone was taking actions that could potentially destroy their business? Me, I can see that it's possible to cause material harm to a business without potentially destroying it. Can you? If you can, do you think it's wrong for that business to defend itself? It looks like that's exactly what you believe.

It just seems
So why do you think it's wrong for a corporation that's been harmed to file a lawsuit? Why do you imply that the harm should potentially destroy their business before it's okay to file that lawsuit?
YOu just said the keywords, potentially destroying their business, I highly doubt that would ever happen and on top of that I have a hard time with preemptive lawsuits, just because you think it may hurt your business is not enough you have to prove that it hurts your busine
Yeah the last thing you want to say in any of these threads is that copyright is broken and that copyright holders shouldn't have the rights to stomp all over their perspective and current customers. Thank goodness copyright for the most part covers things I can live without.
Wow I love this such fun to read.
Because botting affects the economy (people use bots to farm items and gold so they can sell gold to players for real money), a lot of people are quite aware that this is happening and have been for as long as WoW's been live.
And yep I am sure WOW would cease to exist with out this over reaction. Not that every other MMO ever created hasn't had to deal with and has maned up and dealt with it accordingly without some over the top lawsuit.
Because Blizzard doesn't play games. They make them. You'd have to sue individual employees, not the company. In addition, I don't think somebody kicking your ass is a violation of their EULA. Using bots, however, is.
Well in my over the top example that you apparently took seriously, Blizzard as a company provided a game that by its design automatically creates an uneven playing feild for someone that started out years after the game was released. Now I don't rea
Yup. Lets start a new Political Party "The Common Sense Party" Trouble is ..... I have a horrible feeling we might not get too many votes ....
Although isn't it impossible for polotics and common sense to go together? ;) Well one can always hope, in fact without hope what does one really have anyway! ;)
I just get the feeling that too many times out there in the real world, motivations are "rip off [whoever's] arm and beat [whoever] with the soggy end". Not pull together and fix the issue. I doubt that will change of course, human nature can be a strange thing at times ..... but you never know, hope springs eternal
Now that is something I can 100% agree with. People in general love to fix symptoms, rarely do we ever try and fix the disease. I would say unti
Wow lots of shining examples lately as to why copyright is broken and needs to be fixed.
Being wholely negative about every issue along the lines of "oh well, what about ..... *snif* "
Well that is pretty much the core of this whole thing, our legal system here in the states uses PRECEDENTS all the time! Without them the system wouldn't be half as good as it is. So why can't one take the something with similar issues and facts and compare it to something else (by the way this is what a PRECIDENT does)? So again I would say a radar dete
Blizzard not having a case to answer. More fool you for not getting into the game from the outset...and thus be on a level playing field.
Uh yeah I know I was just making an absurd example. Kind of like the absurdity of this one. ;) Yep and and Blizzard has every right to keep banning people if they are dumb enough to keep buying the bot. To use the radar detector example no one can sue the manufacturer for people using their device to do
Come on this is not breaking coyright or a law. Blizzard is just going way overboard. If they don't like what a user is doing on their servers ban them then move on. Anything else is just petty. As for people losing the enjoyment of there game, give me a break, I would bet that none of the users on WOW even knew it was happening let alone affected them. Second what stops me from sueing Blizzard because I start at a disadvantage in WOW if I start now versus someo
This is such a lame topic! PC Gaming will go away when computers go away. As that won't be happening anytime in the near future anyone that thinks PC gaming is dying is just plain diluted.
The best thing about the XBOX 360 for me is the fact that I can make it a Media Center extender and watch all my movies and listen to all my music anywhere the XBOX 360 is connected. In fact I have been using my XBOX 360 to watch netflix watch now movies for months all you need is a plugin for media center and off you go! Woohoo!
Just to clarify a few things that have been brought up but are wrong. 1. The price for an XBOX 360 is still cheaper than a PS3. Just cause you may have to buy something you want doesn't mean everyone else does. I bought mine and I am able to play everything I want haven't had to buy a single addon. 2. You do not in anyway have to pay to play games on line with an XBOX 360, you just need an internet connection. Not sure where that comes from. 3.&nbs
