No, as I have tried to point out, the courts have the say on what is constitutional and what is not. At that suggestion, I am shouted down and told that I am too court happy and don't like the government to operate the real way, by people changing. He was not representing himself, he was representing the american people, and the United States, and therefore the United States is bound by its laws. Dr. Guy, while the actual event involved an actual resisting arrest takedown, the sub plot regarded what the paratroopers would do with the people (assuming the didn't resist arrest). They deemed it impossible to try them in a civilian court because they could never let the world know of the planned attack. They decided they would have to kill the people by getting them to "resist arrest". Lucky for them, the people really did resisit arrest.
