If you read it, it isn't an exclusivity agreement for everything, just one specific product line that hasn't come out yet for a 10 year period...Bungie can still work on other games for other companies. And Activision gets only exclusive publishing rights ro whatever this IP ends up being...Bungie retains ownership over the IP.
This is one of those games, unfortunately, where a remake is inevitably going to piss people off. If they change too much, people will complain that you've ruined it. If they don't change enough, people will complain at being charged to buy what is essentially just the same game with prettier graphics. It's a no win situation.

I actually don't think them offering a ton of their games elsewhere would make them much money, anyway. Well, if they wanted an integrated multiplayer portal, they had 3 choices...build their own from the ground up, Steamworks or Games for Windows Live. It seems the first wasn't an option, so it was one of the only two games in town.
Actually, your Warhammer comparison is apt...both the Warhammer table top game and the Blood Bowl table top game are by Games Workshop, and they share a lot of races, gear, etc.

I haven't had a chance to spend much time with AI War, but I quite like it. The demo really lets you get in to the game and see if it's something you'll like. I can't speak to the differences as I don't have Sins.
And that's the way things will continue for the forseeable future. Why? Graphics sell games. Until AI starts becoming as big a consideration for consumers as graphics engines are, nothing is going to change.
